The Service may be used either by an entity, for example, an employer which has executed an agreement with COMMUNi (a “Customer”) or by individuals (such as Customer’s employees) (“End User(s)”) (Customers and End Users shall collectively be referred to as “Users” or “you”)

 

By using the Service, you consent to all the terms of this Privacy Policy, as amended from time to time. If you do not agree to all of the terms of this Privacy Policy, please do not Use the Service.

 

This Privacy Policy applies to any browsing, visiting, downloading, creating a user account, uploading of information, or any other act or use in connection with the Service (“Use”).

You are not required by law to use the Services or to provide your information to COMMUNi, or to agree to all the terms of this Privacy Policy.

You declare that you are at least 18 (eighteen) years of age.

When a Customer provides or uploads information pertaining to its End Users in connection with the Service, the Customer must have lawfully obtained the consent of each such End User to do so and procure that each such End User agree and consent to all the terms of this Privacy Policy. In such case, the Customer undertakes that each such End User shall, at all times, comply with all of the terms of this Privacy Policy and applicable law, and that, in the event, that, at any time, such End User does not comply with all such terms and/or applicable law, the Customer shall not allow such End User to use the Service. The Customer shall be solely responsible and liable for all acts or omissions of such End User in connection with the Service and for obtaining the necessary and valid and consents from the End Users in connection with their use of the Service.

COMMUNi may make changes to this Privacy Policy. The binding version of this Privacy Policy, at all times, is the most recent version displayed on the Website or Platform, and you accept and agree to all the provisions of this Privacy Policy, as amended from time to time. If you do not agree to any change to this Privacy Policy, you should discontinue your Use of the Service.

What Information Does COMMUNi Process

COMMUNi will receive, collect, process, use and store (“process”) the following information about you during your Use of the Service:

  • Information and content you provide us - COMMUNi collects the content, communications and other information you provide when you use the Service, including when you sign up for an account, create or share content, and message or communicate with us or others, such as full name, telephone number, address, email address, familial information, I.D. number, position, role and financial information. This can also include the content that you share or upload in connection with the use of the Service as well as information about such content (like metadata). The Platform automatically processes content and communications you and others provide to analyze them for the purposes described below. 

 

  • Networks and connections - COMMUNi collects information about Users you are connected to and how you interact with them on the Platform.

 

  • Your usage - COMMUNi collects information about how you use the Service, such as the types of content you view or engage; the features you use; the actions you take, offers and services that interested you, your browsing habits, usage data, duration of your sessions, web pages you have browsed, location data, IP address, device ID number, device location, device type and settings, language and browser type, and fields of interest you have indicated.

 

  • Information about transactions made using the Service - if you use the Service for purchases or other financial transactions, COMMUNi collects information about the purchase or transaction. This includes payment information, such as, your credit or debit card number; account and authentication information; and billing, shipping and contact details.

 

  • Information from third parties - COMMUNi may receive information about you from other sources and third parties in accordance with the consent and agreement between you and these third parties, such as, advertisers, business partners or social networks and in the case of Users, the relevant Customer. COMMUNi may also receive and analyze content, communications and information that others provide when they use the Service, which can include information about you.  

 

  • Inferences drawn from any of the above information: about your preferences, predispositions, interests and behavior as they relate to the Service.

How Does COMMUNi Use Your Information

COMMUNi will process your information for the following purposes:

  • to interact with you, operate and facilitate the access to and use of the Service, its features and functionalities, develop, improve and customize the Service, to manage the administrative and operational aspects of the Service; 

 

  • To provide services to our Customers (including, if you are an End User, the organization you are employed by), in order to enable organizations to engage and retain their employees;

 

  • to improve and customize your experience when you Use the Service;

 

  • to send you updates, provide you with support, handle complaints and contact you when we believe it to be necessary;

 

  • to send you direct mail, marketing information, newsletters, advertisements and promotional offers that may be of interest to you;

 

  • for analysis purposes, monitoring, managing, segmentation and improvement of COMMUNi's services;

 

  • to enforce the terms of this Privacy Policy and any terms of use applicable to the Service,  prevent unlawful activities and misuse of the Service; 

 

  • to comply with any applicable law and assist law enforcement agencies and competent authorities, when we have a good faith belief that our cooperation with them meets the applicable legal standards; 

 

  • to take any action in any case of a dispute involving you with respect to the Service.

Storing and processing all the above information about you is based on the need to enable you to Use the Service and to provide you with COMMUNi's services, to monitor or enforce compliance with COMMUNi's policies and applicable law, on your consent, or on COMMUNi's legitimate interests in operating the Service

With Whom Will COMMUNi Share Information 

 

COMMUNi will transfer your information to the following third parties:

  • in the case of an End User, to the relevant Customer (i.e., the organization that employs such End User and to whom COMMUNi provides services); 

 

  • persons that may be granted access to information about you by order of a judicial body or any regulatory body;

 

  • persons that purchase the activities of the Service, or that merge with COMMUNi, all provided that such persons agree to substantially the same terms as this Privacy Policy.

Transfer of Information Outside of Israel

You are aware and agree that COMMUNi will transmit information about you outside the borders of Israel. In such a case, the transfer of such information will be performed in accordance with the terms of this Privacy Policy and as required by applicable law.

 

When Will COMMUNi Share Information with Others

 

COMMUNi will transfer information about you to third parties (as detailed below) in Israel and abroad (including to servers in a cloud):

  • or the purposes and uses set forth in the COMMUNi Terms of Service and any other terms of use applicable to the Service and this Privacy Policy, to support and operate the Service and in connection with the provision of COMMUNi's services on the Service;

 

  • in the case of End Users, information about your use of the Platform will be provided to the relevant Customer (i.e., the organization that employs you and to whom COMMUNi provides services), provided that COMMUNi will not share with the Customer any private communications exchanged between End Users or the content of any transactions made by End Users using the Service;  

 

  • content that you upload on to the Platform will be shared with, and viewable by, other Users of the Service from the relevant Customer (i.e., the organization that employs you and to whom COMMUNi provides services); 

 

  • in the event that COMMUNi believes that disclosure of such information is necessary to: comply with any applicable law, regulation, legal process or governmental request; enforce the terms of this Privacy Policy, Terms of Service and any other terms of use applicable to the Service including investigations of potential violations thereof; detect, prevent, or otherwise address fraud or security issues; or protect against harm to COMMUNi's rights, property or safety, yourself or the public;

 

  • in the event that COMMUNi receives a judicial order or regulatory instruction directing it to provide the information;

 

  • in the event that COMMUNi is acquired by, or merges with a third party entity, or COMMUNi operates or merges the activities of the Service with the activities of a third party entity, all provided that the other such entity agrees to substantially the same terms of this Privacy Policy.

Data Owner (Controller) and Data Possessor (Processor)

 

We are the “Data Owner” (Controller) only of information relating to the users of our Website. 

 

All information which will be uploaded to the Platform or will be processed in connection with the Platform and provided to the Customer will only be processed by us on the relevant Customer's behalf. In such instances, the Customer shall be deemed the “Data Owner” (Controller) of such information, and we will process such information on its behalf, as its “Data Possessor” (Processor). In the event that our relationship with the Customer is canceled or terminated, we may process only aggregated, and/or anonymized and/or de-identified information (see further below).

Anonymization

 

In the event that our relationship with the Customer is canceled or terminated, we may anonymize (de-identify) any information we have processed about you in connection with the Platform. We may process the de-identified information (and/or aggregated information) in any way, including by selling, or making it available, to any other third party, and for any purpose. 

 

Your Rights in the Information

 

You have the following rights about the information you provide COMMUNi:

 

  • The right to review the information – you are entitled to review information that was processed about you, that is stored in COMMUNi's databases, and which is identified and associated with you. It is not possible to review information which is not identified and associated with you. 

 

  • The right to amend information – if you find that the information stored about you is not correct, complete, clear or up-to-date, you may contact COMMUNi by submitting a detailed request to amend or delete the information.

 

To exercise these rights, please contact COMMUNi by using the contact information provided below. COMMUNi will review your application and respond according to the timeframes prescribed by applicable law. 

 

  • The right to cancel consent – you are entitled, at any time, to cancel your consent to receive direct mail by contacting COMMUNi with an appropriate request. For additional details, see the section on direct mail and advertising notifications below. 

 

  • Additional rights regarding information – you may be entitled to additional rights regarding the information: rights to have your information erased; rights to limit and stop the processing of information; and rights regarding the transfer of information to other persons.

Direct mailing and advertising 

You agree that COMMUNi (and anyone on its behalf) may use the contact information you provide it on the Service and information processed about you during your Use of the Service: to interact with you; to offer and send you marketing content, direct mailing, newsletters, updates and advertising; and to notify you of COMMUNi's services, from time to time (“Mail”). 

 

The Mail will be sent to you via e-mail, SMS messages and/or any other means of communication.

COMMUNi assumes no liability or responsibility for any damage you may incur as a result of such penetration, unauthorized use, or theft of information from COMMUNi's databases or the Service.

 

Any Use of the Service through the Internet could expose you to a variety of dangers associated with using the Internet, such as, computer or mobile phone penetration, viruses, malware, etc. Use of the Service is at your sole responsibility. COMMUNi recommends that you install adequate security software and security means before using the Service and COMMUNi's services through the Internet.

 

You agree that COMMUNi assumes no liability or responsibility for any loss or damage of any kind caused to you or anyone on your behalf by Using the Service, if any information about you is lost, disclosed to an unauthorized third party or is used without permission.

 

Until When Will COMMUNi Keep the Information

 

COMMUNi will keep information about you during the period in which you Use the Service, and afterwards for the purpose of providing its services and sending offers and updates or other notifications, all in accordance with the terms of this Privacy Policy.
